Questions and Answers

1. Q. What is the relationship between possion and ownership?

A. Possession is the most basic form of proving ownership.

2. Q. Why do you think seeing is not acquiring?

A. To acquire, a person must take possession. Seeing is not an action of possessing.

3. Q. What are two meanings of Kol D'alim Gaver?

A. 1. The strongest one wins, in a physical fight. 2.The best argument or proof wins in a debate.

4. Q. Why don't we put the TALLIS in possession of the court temporarily until the time of Eliyahu?

A. Such a procedure is used when we are uncertain what the law is in a case. Here, though, we are certain what the law is. Unless proven otherwise, both children are assumed to have picked up the TALLIS at the same time, and therefore they should divide it.

5. Q. Why does an oath prevent thieving?

A. 1. If a person has any doubt, he will not swear before the Torah. 2. Some people are more afraid to swear falsely in front of the Al-mighty than to steal.

6. Q. How does the court divide the TALLIS? Why?

A. One person should buy the out the other's half or the TALLIS is sold to a third party and the money is divided in order not to devaluate the TALLIS as a whole by cutting it.
